ORDER
WHEREAS:
A. On March 7, 2018, the British Columbia Hydro and Power Authority (BC Hydro) filed with the British Columbia Utilities Commission (BCUC) pursuant to sections 58 to 61 of the Utilities Commission Act (UCA), an Application to Amend Tariff Supplement No. 74 Customer Baseline Load (CBL) Determination Guidelines (Application);
B. The proposed amendments fall into the following categories: (i) house-keeping updates; (ii) new provisions incorporating prior BCUC approved CBL adjustments, in accordance with sections 1.0 and 6.2.2 of TS 74; and (iii) new adjustments discussed and agreed to by BC Hydro in BC Hydro’s consultation process with Transmission Service Rate (TSR) customers and the Association of Major Power Customers of BC (AMPC);
C. In compliance with Directive 3 of Order G-36-16, BC Hydro also addresses in the Application whether it should modify TS No. 74 to remove wording that “all Energy CBLs and any decision to put a customer on RS 1823A will be subject to final approval by the Commission”;
D. In the Application, BC Hydro states that it undertook extensive consultation with TSR customers and the AMPC on the proposed changes;
E. By Order G-80-18 dated April 25, 2018, the BCUC established a written comment process and a regulatory timetable for the review of the Application. The BCUC directed BC Hydro to provide notice of the Application to its TSR and CBL customers and stakeholders, inviting them to submit letters of comment on the Application on or before, May 4, 2018;
F. By May 7, 2018, the BCUC received comments from two TSR customers expressing support for the amendments; and
G. The BCUC reviewed the Application and all submissions and considers that approval is warranted.
NOW THEREFORE pursuant to sections 59 to 61 and 89 of the UCA, the British Columbia Utilities Commission orders as follows:
1. The proposed amendments to the BC Hydro Tariff Supplement No. 74 CBL Determination Guidelines in the Amended Application are approved, effective April 1, 2017.
2. Tariff Supplement No. 74 will continue to use the wording “all Energy CBLs and any decision to put a customer on RS 1823A will be subject to final approval by the Commission.”
3. BC Hydro must send a copy of the approved Tariff Supplement No. 74 to all TSR customers within 30 days of the date of this order.
