ORDER
WHEREAS:
A. On May 23, 2018, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between FEI and Terminal Fruit & Produce Ltd. (TFP) (TFP-Burnaby Agreement) on an interim and permanent basis, effective May 24, 2018 (Application);
B. On May 22, 2018, FEI and TFP entered into the TFP-Burnaby Agreement which establishes rates for TFP to receive CNG from the CNG station located at the FEI Burnaby Operation facility in Burnaby, BC for a 30 day pilot project;
C. The BCUC has reviewed the Application and determines that rates should be approved on a permanent basis.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established in the TFP-Burnaby Agreement are approved on a permanent basis, effective May 24, 2018.
2. FEI is to file the TFP-Burnaby Agreement in tariff supplement form for endorsement by the BCUC within 30 days of the date of this order.
