Section 71 Filing of Primary Metering Service Agreement with Lincoln Electric Cooperative, Inc.

ORDER
WHEREAS:
A. On June 15, 2018, pursuant to section 71 of the Utilities Commission Act, British Columbia Hydro and Power Authority (BC Hydro) filed with the British Columbia Utilities Commission (BCUC) an application to accept The Primary Metering Service Agreement, an energy supply contract (ESC), between BC Hydro and the Lincoln Electric Cooperative, Inc.(LEC) (2018 Agreement), effective June 1, 2018 (Filing);
B. Concurrent with the filing, BC Hydro advised the BCUC that is had provided a copy of the Filing to interveners in the BC Hydro Fiscal 2017 to Fiscal 2019 Revenue Requirements Application;
C. By Order G-61-12, dated May 17, 2012, the BCUC approved the Rules for Energy Supply Contracts for Electricity (Rules). Appendix A of Order G-61-12 contains the Rules, which are intended to facilitate the BCUC’s review of ESCs for electricity, pursuant to section 71 of the UCA;
D. BC Hydro first signed an agreement to purchase electricity from LEC in 1971, with subsequent renewals in 1972, 1975, and 1981. The last renewal from 1981 (1981 Agreement) is currently in effect subject to a six-month termination notice and has not been amended to date;
E. To meet additional load requirements, BC Hydro and LEC have entered into the 2018 Agreement which increases the monthly power capacity from what was agreed to in the 1981 Agreement; and
F. The BCUC has reviewed the Filing in accordance with the criteria under section 71(2.21) of the UCA and requirements under the Rules, and considered the information provided in the Filing. The BCUC finds that the 2018 Agreement is in the public interest.
NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the BCUC’s Rules for Energy Supply Contracts, the BCUC accepts for filing The Primary Metering Service Agreement effective June 1, 2018 between BC Hydro and Lincoln Electric Cooperative, Inc.
