ORDER
WHEREAS:
A. On August 31, 2018, FortisBC Energy Inc. (FEI) filed an application with the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between FEI and Halton Recycling Ltd. D.B.A. Emterra Environmental (Emterra) (Emterra-Burnaby Agreement) on an interim and permanent basis, effective August 31, 2018 (Application);
B. On August 28, 2018, FEI and Emterra entered into the Emterra-Burnaby Agreement which establishes rates for Emterra to receive CNG from the CNG station located at the FEI Burnaby Operation facility in Burnaby, BC for a three year period; and
C. The BCUC has reviewed the Application and considers that rates should be approved on a permanent basis.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established in the Emterra-Burnaby Agreement are approved on a permanent basis, effective on August 31, 2018.
2. FEI is to file with the BCUC the Emterra-Burnaby Agreement in tariff supplement form for endorsement within 30 days of the date of this order.
