ORDER
WHEREAS:
A. On January 28, 2019, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between BC Transit Corporation (BC Transit) and FEI (the BC Transit-Langford Agreement) on an interim and permanent basis, effective February 1, 2019 (Application);
B. On December 14, 2018, FEI and BC Transit entered into the BC Transit-Langford Agreement which established the rates for BC Transit to receive CNG from the CNG Fueling Station located at FEI’s Victoria Regional Office facility in Langford, BC (the Langford Fueling Station);
C. On February 21, 2019 FEI submitted an Amending Agreement to the Fueling Services Agreement between BC Transit and FEI (the BC Transit-Langford Amending Agreement) in order to reflect the rates effective January 1, 2019 for fueling at the Langford Fueling Station; and
D. The BCUC has reviewed the Application and considers that approval of the rates established by the BC Transit-Langford Agreement and updated by the BC Transit-Langford Amending Agreement is warranted on a permanent basis.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established by the BC Transit-Langford Agreement and updated by the BC Transit-Langford Amending Agreement are approved, on an permanent basis, effective February 1, 2019;
2. FEI is to file the BC Transit-Langford Agreement and the BC Transit-Langford Amending Agreement in tariff supplement form for BCUC endorsement within 30 days of the date of this order.
