ORDER
WHEREAS:
A. On February 6, 2019, Connect TES (Richmond) Holdings Inc. filed with the British Columbia Utilities Commission (BCUC) an application to extend the Parc Riviera Stream A Thermal Energy System to serve Building G (Parc Riviera Building G TES), in accordance with the BCUC Thermal Energy Systems Regulatory Framework Guidelines (TES Guidelines);
B. On August 28, 2014, the BCUC issued Order G-127-14 approving the TES Guidelines and on March 2, 2015, revisions to the TES Guidelines were approved by Order G-27-15;
C. Under Section 2.1 of the TES Guidelines, a Stream A TES is defined as: “An On-Site TES with an Initial Capital Cost above $500,000 but less than $15,000,000 is exempt from sections 44.1, 45 to 46 and 59 to 61 of the UCA [Utilities Commission Act]. TES Providers are required to register Stream A TES prior to building or otherwise acquiring the Stream A TES”;
D. Under Section 2.3.5 of the TES Guidelines, the BCUC must be notified of any extension to a Stream A TES by way of a Stream A Application “provided the sum of the proposed extension and the initial system (plus any pervious extensions) does not exceed $15 million” and the extension does not result in service to customers on a site different to the site on which the TES is located.
E. On November 4, 2016, Axsiom GeoEnergy (Richmond) Corporation (Axsiom) filed with the BCUC an application to register the Stream A Parc Riviera TES in accordance with the TES Guidelines;
F. On December 19, 2016, by Order G-194-16 the Parc Riviera TES was registered as a Stream A TES and exempted from sections 44.1, 45 to 46 and 59 to 61 of the UCA;
G. On February 8, 2017 Axsiom changed its name to Connect TES (Richmond) Holdings Inc.;
H. The BCUC has reviewed the application and is satisfied that the total capital cost does not exceed $15 million, the extension does not result in service to customers on a site different to the site on which the TES is located and the Parc Riviera Building G TES meets the characteristics of a Stream A TES. The Parc Riviera Building G TES is therefore suitable for exemption from sections 44.1, 45 to 46 and 59 to 61 of the UCA.
NOW THEREFORE pursuant to section 88(3) of the UCA and by the advance approval of the Lieutenant Governor in Council (Order in Council 400), the BCUC orders as follows:
1. In accordance with the TES Guidelines, the Parc Riviera Building G TES is exempt from sections 44.1, 45 to 46 and 59 to 61 of the UCA.
2. Connect TES (Richmond) Holdings Inc. must file with the BCUC, an annual report for the Parc Riviera Building G TES in accordance with Stream A annual reporting guidelines as provided in Appendix B of the TES Guidelines.
