Code of Conduct and Transfer Pricing Policy Application

ORDER

WHEREAS:

 

A.      On January 31, 2019, Pacific Northern Gas Ltd. (PNG) filed an application for approval of PNG’s Code of Conduct (COC) and Transfer Pricing Policy (TPP) (Application);

B.      By Order G-157-18 dated August 15, 2018, the British Columbia Utilities Commission (BCUC) directed PNG to submit for approval an updated COC and TPP in accordance with Directive 7 of the order no later than December 31, 2018;

C.      On December 17, 2018, PNG submitted a request to the BCUC seeking a one-month extension on the submission of the Application, from December 31, 2018 to January 31, 2019;

D.      On December 19, 2018, the BCUC issued a letter approving PNG’s request; and

E.       The BCUC has reviewed the Application and considers that a regulatory timetable is warranted.

 

NOW THEREFORE pursuant to sections 58 to61 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       A written hearing process and regulatory timetable is established, as set out in Appendix A to this order.

2.       As soon as reasonably possible, PNG is to publish the Application, this order and the regulatory timetable on its website and to provide a copy of the Application and this order and the regulatory timetable to registered interveners in the PNG(N.E.) and PNG-West 2018–2019 Revenue Requirements Application proceedings.

3.       In accordance with the BCUC’s Rules of Practice and Procedure, parties who wish to participate in the regulatory proceeding are to register with the BCUC by completing a request to intervene form, available on the BCUC’s website, by the date established in the regulatory timetable attached as Appendix A to this order.
