ORDER

WHEREAS:

A.      On July 19, 2019, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates, established in the fueling services agreement between FEI and Yen Bros Food Services Ltd. (Yen Bros.) (FEI-Yen Bros Agreement), on an interim and permanent basis, effective August 1, 2019 (Application);

B.      On July 19, 2019, FEI and Yen Bros. entered into a fuel service agreement which established the terms, conditions, and rates for Yen Bros. to receive CNG fueling service at the FEI Burnaby Operations Facility in Burnaby, BC; and

C.      The BCUC has reviewed the Application and determines that rates should be approved on a permanent basis.

NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:

1.       The rates established in the FEI-Yen Bros. Agreement are approved on a permanent basis, effective
August 1, 2019.

2.       FEI is to file the FEI-Yen Bros. Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
