ORDER

WHEREAS:

 

A.      On July 19, 2019, ForitisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between FEI and Vedder Transportation Ltd. (Vedder) (FEI-Vedder Agreement), on an interim and permanent basis, effective July 19, 2019 (Application); 

B.      On March 11, 2014, the BCUC issued Order G-34-14 approving the rate design and rate of FEI’s Mobile
Re-Fueling Equipment Agreement with Denwill Enterprises Inc. (Denwill) (Denwill Agreement) for LNG fueling service;

C.      On February 2, 2017, the BCUC issued Order G-16-17 approving the rates established in the fuel services agreement between FEI and Vedder on a permanent basis, effective January 1, 2017, allowing Vedder to use FEI’s Mobile Re-Fueling Unit (MRU) located on Denwill’s property for re-fueling services (Vedder-Denwill Agreement);

D.      In late 2018, Denwill removed their LNG trucks from operation and ceased to use the Denwill Fueling Station. Due to non-payments of amounts owing for services provided and for not abiding to the terms of agreement, FEI terminated the Denwill Agreement which resulted in the termination of the FEI-Vedder Agreement;

E.       On February 15, 2019, FEI entered into a Host Agreement with Canadian Utility Construction Corp. (CUC) to sublease a portion of property to relocate the MRU from the Denwill location;

F.       On May 27, 2019, FEI and Vedder entered into the FEI-Vedder Agreement which establishes the conditions for Vedder to continue to receive LNG refueling services from the MRU now located at CUC; and

G.     The BCUC has reviewed the Application and determines that rates be approved on a permanent basis.

 

NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:

 

1.       The rates established in the FEI-Vedder Agreement are approved on a permanent basis, effective July 19, 2019.

2.       FEI is to file the FEI-Vedder Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
