ORDER

WHEREAS:

 

A.      On January 31, 2019, Pacific Northern Gas Ltd. (PNG) filed an application for approval of PNG’s Code of Conduct (COC) and Transfer Pricing Policy (TPP) (Application);

B.      PNG’s existing COC and TPP, dated November 2011, were approved by British Columbia Utilities Commission (BCUC) Order G-130-12. These policies were prepared in consideration of the BCUC’s Retail Market Downstream of the Utility Meter (RMDM) Guidelines;

C.      By Order G-157-18 dated August 15, 2018, the BCUC directed PNG to submit for approval an updated COC and TPP, in accordance with Directive 7 of the order, no later than December 31, 2018;

D.      On December 17, 2018, PNG submitted a request to the BCUC seeking a one-month extension on the submission of the Application, from December 31, 2018 to January 31, 2019, which was approved by a letter issued on December 19, 2018;

E.       On April 30, 2019, the BCUC issued Order G-94-19 establishing a regulatory timetable which included intervener registration and one round of information requests (IR) with further process to be determined;

F.       On July 15, 2019, the BCUC issued Order G-157-19 establishing a further regulatory timetable, including a Panel IR to PNG with further process to be determined;

G.     By Order G-208-19 dated September 3, 2019, the BCUC amended the regulatory timetable including filing of a final argument;

H.      The BCUC notes the absence of registered interveners in the proceeding and no opposition from interested parties to PNG’s proposed COC and TPP; and

I.        The BCUC has reviewed the Application and the evidentiary record and is satisfied that PNG’s proposed and updated COC and TPP appropriately addresses interactions between PNG and its affiliated companies in accordance with the RMDM Guidelines.

 

NOW THEREFORE pursuant to sections 58 to 61 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       PNG’s proposed COC and TPP, with the amendments as appended to BCUC Exhibit B-3 are approved.

2.       PNG is to file an amended COC and TPP as approved with the BCUC within 60 days of the date of this order.

3.       PNG is to file its Compliance Reports to the BCUC in accordance with Section 7.5 of the COC and TPP.

4.       Upon request by the BCUC, from time to time, PNG is to provide the documents in Section 7.7 of the COC and TPP.
