ORDER

WHEREAS:

 

A.      On October 21, 2019, the British Columbia Hydro and Power Authority (BC Hydro) applied to the British Columbia Utilities Commission (BCUC), pursuant to the BC Government’s Direction to the BCUC Respecting Liquefied Natural Gas (LNG) Customers (Order in Council [OIC] No. 512 issued on October 2, 2018, BC Reg, 197/2018) (Direction), for approval to rescind Tariff Supplements (TS) 91 and 92 for the FortisBC Energy Inc. (FEI) Tilbury Island LNG Facility (Application);

B.      TS 91, the Electricity Supply Agreement, and TS 92, the Load Interconnection Agreement, are related to the provision of electricity to the FEI Tilbury Island LNG Facility;

C.      The Direction requires the BCUC to implement the BC Government’s policy related to the provision of electricity service to LNG customers;

D.      Section 3 (1) of the Direction requires that the BCUC must allow BC Hydro to rescind TS 91 and/or TS 92;

E.       BC Hydro and FEI have agreed to transition the FEI Tilbury Island LNG Facility account to be served under TS 5, the Electricity Supply Agreement, and Rate Schedule 1823, effective the date of the BCUC Order to rescind TS 91 and TS 92; and

F.       The BCUC has reviewed the Application in accordance with the Direction and considers that approval is required as directed.

NOW THEREFORE pursuant to the Direction to the BCUC Respecting LNG Customers (OIC 512/2018) and the Utilities Commission Act, the BCUC orders rescindment of TS 91, Electricity Supply Agreement, and TS 92, Load Interconnection Agreement, be approved effective the date of this Order.
