Section 71 Filing of Natural Gas Supply Contracts for the Commodity and Midstream Portfolios

ORDER
WHEREAS:
A. On October 31, 2019, pursuant to section 71 of the Utilities Commission Act (UCA) and section 6.0 of the British Columbia Utilities Commission’s (BCUC) Rules for Natural Gas Energy Supply Contracts that are set out in Appendix A to BCUC Order G-130-06, FortisBC Energy Inc. (FEI) filed for acceptance with the BCUC natural gas supply contracts for the commodity and midstream portfolios that have been transacted for the 2019/2020 gas contracting year (Filing);
B. FEI requests acceptance of the following:
i. the commodity term supply allocation between monthly and daily priced contracts as well as the monthly and daily market premiums for commodity baseload and seasonal transactions not yet accepted by the BCUC;
ii. the midstream supply allocation between monthly and daily priced contracts as well as the monthly and daily market premiums for midstream seasonal transactions, and newly executed and approved storage and transportation contracts were also referenced for informational purposes;
C. By Letter L-32-19 dated June 19, 2019, the BCUC accepted the FEI Annual Contracting Plan (ACP) for the 2019/20 gas year commencing November 1, 2019, and requested that FEI file an update to the 2019/20 ACP to address transmission service customers returning to bundled service;
D. By Letter L-40-19 dated August 8, 2019, the BCUC accepted the update to FEI’s 2019/20 ACP;
E. FEI requests that the Filing and associated documents remain confidential due to their commercially sensitive nature; and
F. The BCUC reviewed the Filing and is satisfied that the contracts are consistent with the 2019/20 ACP and the 2019/20 ACP update, the market factors are appropriate considering market prices at the time they were negotiated and the contracts are in the public interest.
NOW THEREFORE pursuant to section 71 of the UCA and the BCUC Rules for Natural Gas Energy Supply Contracts, the BCUC accepts the natural gas contracts shown in Appendix A to this order. The BCUC will hold the details of the Filing and associated documents confidential as requested by FEI as they contain commercially sensitive information.
