ORDER
WHEREAS:
A. On January 10, 2020, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates, established in the fueling services agreement between FEI and Fresh Direct Produce Ltd. (Fresh Direct) (FEI-Fresh Direct Agreement), on an interim and permanent basis, effective January 15, 2020 (Application);
B. On May 17, 2017, by Orders G-72-17 and G-73-17, the BCUC found that the Compressed Natural Gas (CNG) station located on FEI’s property in Burnaby, British Columbia (Burnaby Operations Fueling Station) met the requirements for a prescribed undertaking as defined by the Greenhous Gas Reduction (Clean Energy) Regulation;
C. On January 9, 2020, FEI and Fresh Direct entered into a fueling service agreement, which established the terms, conditions, and rates for Fresh Direct to receive CNG fueling service at the Burnaby Operations Fueling Station; and
D. The BCUC has reviewed the Application and determines that approval of the rates on a permanent basis is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established in the FEI-Fresh Direct Agreement are approved on a permanent basis, effective January 15, 2020;
2. FEI is to file the FEI-Fresh Direct Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
