ORDER

WHEREAS:

 

A.      On April 30, 2020, pursuant to section 71 of the Utilities Commission Act (UCA), British Columbia Hydro and Power Authority (BC Hydro) filed with the British Columbia Utilities Commission (BCUC) an electricity purchase agreement (EPA) with a three-year term between BC Hydro and Robson Valley Power Corporation (RVPC) for the Robson Valley hydroelectric project (Robson Valley EPA Renewal), effective February 1 , 2020 (Filing);

B.      By Order G-61-12, dated May 17, 2012, the BCUC approved the Rules for Energy Supply Contracts for Electricity (Rules). The Rules, set out in Appendix A of Order G-61-12, are intended to facilitate the BCUC’s review of energy supply contracts for electricity, pursuant to section 71 of the UCA;

C.      On March 27, 2020, BC Hydro requested an extension from the 60-day filing rule for the filing of EPAs, or amendments, as set out in the Rules, for the Robson Valley EPA Renewal;

D.      By letter dated March 30, 2020, the BCUC granted BC Hydro’s filing extension request;

E.       BC Hydro requests the un-redacted version of the Filing, including the Robson Valley EPA Renewal, be held confidential as it contains commercially sensitive information; and

F.       The BCUC has commenced a review of the Filing and considers a regulatory timetable is warranted.

NOW THEREFORE pursuant to section 71 of the UCA and the Rules, the BCUC orders the following:

1.       A public hearing is established for the review of the Filing, as set out in the Regulatory Timetable attached as Appendix A to this order.

2.       The BCUC will hold the un-redacted version of the Filing confidential, as it contains commercially sensitive information and the disclosure is not in the public interest.

3.       BC Hydro is directed, as soon as reasonably possible, but no later than June 4, 2020, to:

a.       Notify, by email or mail, registered interveners of the most recent BC Hydro revenue requirements application, all First Nations within the consultative boundaries of the Robson Valley facility and any person in the Robson Valley region that has participated in previous hearings as they relate to this facility, of the Filing, this order, and the Regulatory Timetable set out in Appendix A to this order;

b.      Publish a copy of the Public Notice attached as Appendix B to this order, in such appropriate news publications as may properly provide adequate notice to the public in the affected service area; and

c.       Post a copy of this order, the Filing and the Public Notice attached as Appendix B to this order, on BC Hydro’s website and all social media channels.

BC HYDRO RENEWAL OF AN ELECTRICITY PURCHASE AGREEMENT
WITH ROBSON VALLEY POWER CORPORATION

On April 30, 2020, BC Hydro filed an application with the British Columbia Utilities Commission seeking acceptance of an electricity purchase agreement (EPA) between BC Hydro and Robson Valley Power Corporation for the Robson Valley hydroelectric project (Robson Valley EPA Renewal). The EPA has a three-year term and is effective February 1, 2020. The BCUC is currently reviewing the application and welcomes public participation in the process.
