Re:         Pembina Kinder Morgan Canada (Jet Fuel) Inc. (PKMJF) – 2019 Tariff Filing Application – Extension to the Filing Deadline for PKMJF’s Supplemental Information Request Responses

 

 

Dear Ms. Twyman:

On August 10, 2020, the BCUC issued Order P-4-20, wherein the BCUC directed PKMJF to:

… provide further and better answers to the information requests attached as Appendix B to this order by Thursday, August 20, 2020. Specifically, PKMJF must provide answers that are responsive to the items outlined in Table 1 of the reasons attached.

Table 1 identified the following information requests as the subject of the requisite supplemental filing: (a) VAFFC(IR2)‑PKMJF 11.1; (b) VAFFC(IR2)-PKMJF 14.1; (c) VAFFC(IR2)-PKMJF 14.2; and (d) Parkland(IR2)-PKMJF 6.1.1-6.1.3 (the Supplemental IR Responses).

On August 14, 2020, Vancouver Airport Fuel Facilities Corporation (VAFFC) submitted a request for, among other things, partial suspension of the amended regulatory timetable in this proceeding following the August 20, 2020 deadline for submission of the Supplemental IR Responses. On August 17, 2020, Parkland Refining (B.C.) Ltd (Parkland) wrote in support of VAFFC’s submission, seconding the request for partial suspension of the regulatory timetable.

By letter L-52-20 dated August 18, 2020, the BCUC provided PKMJF with an opportunity to submit written comment in response to the VAFFC and Parkland requests by August 20, 2020. In that same letter, the BCUC invited reply submissions from VAFFC and Parkland (Intervener Reply) by August 25, 2020.

On August 20, 2020, PKMJF responded to the VAFFC and Parkland suspension requests, and requested an extension to the deadline for the submission of the Supplemental IR Responses. In support of its extension request, PKMJF states that the purchase of the Jet Fuel Line is part of a much larger transaction, which has a significant volume of associated documents. PKMJF submits that it requires time to review the documents pertinent to the Jet Fuel Line, many of which comprise numerous pages, including documents that are not electronically searchable. Further, PKMJF submits that it requires time to review documents potentially responsive to the Supplemental IR Responses for relevance, commercial sensitivity, and third-party confidentiality obligations. PKMJF requests an extension of the submission deadline for the Supplemental IR Responses from August 20, 2020 to September 10, 2020, in order to allow additional time for PKMJF to identify and produce such documentation as is appropriate in the circumstances.

The BCUC approves PKMJF's request for an extension of the filing deadline for the Supplemental IR Responses to September 10, 2020. An updated regulatory timetable will follow in due course as part of the Panel’s broader consideration of the regulatory schedule in this proceeding, after the August 25, 2020 submission deadline for Intervener Reply on the VAFFC and Parkland suspension requests.
