ORDER

WHEREAS:

 

A.      On November 29, 2018, Kinder Morgan Canada (Jet Fuel) Inc. (KMJF) filed with the British Columbia Utilities Commission (BCUC) an application for approval of Tariff No. 40, which extends the existing terms of service and tolls payable for the transportation of turbine fuel to Vancouver International Airport and the Burnaby Terminal (Application), effective January 1, 2019;

 

B.      By Order P-1-18 dated December 14, 2018, the BCUC established a public written submission process and a regulatory timetable to explore stakeholders’ submissions or other potential issues;

 

C.       By April 24, 2019, the Vancouver Airport Fuel Facilities Corporation (VAFFC) and Parkland Refining (B.C.) Ltd. (Parkland) registered as interveners in the proceeding;

 

D.      On January 6, 2020, Pembina Pipeline Corporation informed the BCUC that it had acquired KMJF, including the Jet Fuel Line, and changed the name to PKM Canada (Jet Fuel) Inc. (PKMJF);

 

E.       By Order P-3-21, dated March 29, 2021, the BCUC established a further amended regulatory timetable for the proceeding, including a procedural conference with date and details to follow;

 

F.       By letter dated April 30, 2021, PKMJF notified the BCUC that the Jet Fuel Line had been shutdown effective immediately, and requested that no changes be made to the regulatory timetable for the proceeding;

 

G.      By letter dated May 14, 2021, VAFFC requested that next steps in the proceeding be considered at a procedural conference in late June; and

 

H.      The BCUC has reviewed PKMJF’s April 30, 2021 and VAFFC’s May 14, 2021 submissions and considers a further amendment to the regulatory timetable is warranted.

 

NOW THEREFORE the BCUC orders that the regulatory timetable established by Order P-3-21 is further amended, as set out in Appendix A to this order.
