ORDER
WHEREAS:
A. On September 9, 2021, British Columbia Hydro and Power Authority (BC Hydro) filed an application with the British Columbia Utilities Commission (BCUC) seeking approval to Amend Attachment C of the Open Access Transmission Tariff (OATT) pursuant to sections 58 to 61 of the Utilities Commission Act (UCA) (Application);
B. In the Application, BC Hydro seeks approval of the following amendments to Attachment C of the OATT:
1. To delete one sentence in section 4.5.1 of Attachment C to enable BC Hydro to address its amended practice to allow firm counterflow schedules to create firm available transmission capability (ATC) for sale under BC Hydro’s OATT if certain conditions are met; and
2. To address additional housekeeping items in Attachment C;
C. On November 21, 2008, British Columbia Transmission Corporation (BCTC) filed with the BCUC its OATT Amendment Application to maintain consistency with the US Federal Energy Regulatory Commission (FERC) pro forma tariff as revised by FERC’s Orders No. 890, 890-A, 890-B, 890-C and 890-D. In the OATT Amendment Application, BCTC proposed to defer any amendments to Attachment C of the OATT, which outlines the Transmission Provider’s methodology for determining ATC, pending approval by FERC of relevant standards and business practices in the US;
D. By Order G-102-09 dated September 10, 2009, the BCUC approved the proposed amendments under the OATT Amendment Application and BCTC’s proposal to defer any amendments to Attachment C of the OATT pending FERC’s approval of relevant business practices in the US;
E. By Order G-192-10 dated December 9, 2010, the BCUC approved the proposed OATT amendments to reflect the integration of BC Hydro and BCTC pursuant to the Clean Energy Act, S.B.C. 2010, c. 16;
F. By Order G-185-11 dated November 10, 2011, the BCUC approved the amendments to OATT Attachment C to be consistent with the ATC methodology under the then-approved MOD-029-1a Rated System Path Methodology;
G. By Order R-39-17 dated October 1, 2017, the BCUC approved reliability standard MOD-029-2a which replaced MOD-029-1a;
H. BC Hydro requests that Appendix D of the Application be kept confidential by the BCUC as it contains market sensitive information; and
I. The BCUC has reviewed the Application and considers the establishment of a public hearing is warranted.
NOW THEREFORE the BCUC orders as follows:
1. A public hearing process is established in accordance with the regulatory timetable, as set out in Appendix A to this order.
2. In accordance with the BCUC’s Rules of Practice and Procedure attached to Order G-5-19, the regulatory timetable for the review of the Application is established, as set out in Appendix A to this order. Parties who wish to actively participate in the proceeding are to register with the BCUC by completing a Request to Intervene Form, available on the BCUC website, by the date established in the regulatory timetable.
3. BC Hydro is directed to provide notice of the Application, this Order, and the Regulatory Timetable on its website and to all customers under the OATT by October 6, 2021.
4. Members of the public are invited to submit letters of comment on the Application. Letters of comment must be received by the BCUC by the last date included in the proceeding’s regulatory timetable before final arguments, unless the BCUC directs otherwise. Letters of comment that are received late will not be considered by the BCUC in the proceeding. Letters of comment must be in the Letter of Comment Form, available on the BCUC website, and submitted by email to commission.secretary@bcuc.com or by mail, courier, or personal delivery to the BCUC, Suite 410, 900 Howe Street, Vancouver, BC V6Z 2N3.
5. Subject to any future determination to the contrary, the BCUC will hold Appendix D of the Application confidential, as requested by BC Hydro because it contains market sensitive information.
