ORDER

WHEREAS:

A.      On September 28, 2021, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval of the cancellation of Tariff Supplement J-8 containing the fueling services agreement between FEI and Canadian Linen and Uniform Services Co. (Canadian Linen) to receive Compressed Natural Gas (CNG) fueling service from the FEI fueling station located at Waste Management of Canada Corporation in Coquitlam, BC (Waste Management Station) (Canadian Linen-Waste Management Agreement), effective September 30, 2021 (Application);

B.      By Order G-283-20 dated November 4, 2020, the BCUC approved the rates established in the Canadian Linen-Waste Management Agreement, effective November 1, 2020, on an interim and recoverable/refundable basis pending BCUC approval of permanent rates between FEI and Waste Management for CNG fueling service from the Waste Management Fueling Station;

C.      Canadian Linen has not taken any fueling service under the Canadian Linen-Waste Management Agreement, and as such, there is no refund or recovery of variances required between the interim rates approved by Order G-283-20 and the permanent rates that would have been determined by the BCUC;

D.      In a letter dated August 16, 2021, Canadian Linen provided written notice to FEI to cancel the Canadian Linen-Waste Management Agreement; and

E.       The BCUC has reviewed the Application and determines that consenting to the rescindment of Tariff Supplement J-8 is warranted.

NOW THEREFORE pursuant to section 61 of the UCA, the BCUC consents to the rescindment of Tariff Supplement J-8, effective September 30, 2021.

DATED at the City of Vancouver, in the Province of British Columbia, this 3rd day of November 2021.
