ORDER
WHEREAS:
A. On February 25, 2021, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of the rates established in the fueling services agreement between FEI and Emterra Environmental (Halton Recycling Ltd.) (Emterra) (Emterra-Langford Agreement), on an interim and permanent basis, effective March 1, 2021, for fueling service at FEI’s Langford fueling station (Langford Fueling Station) located in Victoria, BC (Application);
B. On December 17, 2020, FEI separately entered into fueling services agreements with ColdStar Solutions Inc. (ColdStar) (ColdStar Agreement) and GFL Environmental Inc. (GFL) (GFL Agreement), each of which established the terms, conditions and rates for ColdStar and GFL, respectively, to receive fueling service from the Langford Fueling Station. On December 23, 2020, FEI applied to the BCUC for approval of the rates established in the ColdStar Agreement and the GFL Agreement, on an interim and permanent basis, effective January 1, 2021 (Langford Renewal Application);
C. By Order G-6-21 dated January 8, 2021, the BCUC established a regulatory timetable for the review of the Langford Renewal Application and approved on an interim and refundable basis, the rates established in the ColdStar Agreement and the GFL Agreement, effective January 1, 2021;
D. On February 5, 2021, FEI and Emterra entered into the Emterra-Langford Agreement which establishes the terms and conditions for Emterra to receive compressed natural gas fueling service from the Langford Fueling Station, effective March 1, 2021, under the rates consistent with BCUC Order G-6-21;
E. By Order G-77-21 dated March 15, 2021, the BCUC approved the rates established in the Emterra-Langford Agreement on an interim and refundable/recoverable basis, effective March 1, 2021;
F. By Order G-311-21 dated October 29, 2021, the BCUC approved the rates established in the ColdStar Agreement and the GFL Agreement, previously approved on an interim basis under Order G-6-21, to be permanent, effective January 1, 2021; and
G. The BCUC has completed its review of the Application, and finds that approval of permanent rates is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established in the Emterra-Langford Agreement are approved on a permanent basis, effective March 1, 2021.
2. FEI is to file the Emterra-Langford Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
