ORDER
WHEREAS:
A. On October 22, 2021, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval and endorsement of Tariff Supplement K-3 containing an amended and restated Biomethane Long Term Large Volume Interruptible Sales Agreement (Agreement) between FEI and South Coast British Columbia Transportation Authority (TransLink), to transfer service from under Rate Schedule 11B - Biomethane Large Volume Interruptible Sales (RS 11B) to service under Rate Schedule 5B - General Firm Biomethane Service (RS 5B), effective November 1, 2021 (Application);
B. By Order G-19-19 dated January 31, 2019, the BCUC approved the RS 11B Tariff Supplement K-3 Biomethane Long Term Large Volume Interruptible Sales Agreement between FEI and TransLink on a permanent basis, effective February 1, 2019;
C. On August 26, 2021, TransLink notified FEI of its intention to transfer its accounts from service under RS 11B to FEI’s bundled service under RS 5B for its accounts where Biomethane is purchased under Tariff Supplement K-3, pursuant to Section 2.7;
D. On November 19, 2021, FEI submitted responses to BCUC Staff Questions dated November 15, 2021. FEI noted that there is a clerical error on the terms of the Agreement, and they will file an amended copy of the agreement subsequent to the BCUC’s order relating to this Application; and
E. The BCUC has reviewed the Application, along with associated documents and finds that approval of the Application is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The FEI Application to amend Tariff Supplement K-3 regarding the Biomethane Long Term Large Volume Interruptible Sales Service Agreement between FEI and TransLink is approved, subject to the correction on the terms of the Agreement, effective November 1, 2021.
2. FEI is directed to file with the BCUC the executed version of the Agreement within 15 days of issuance of this Order.
