Complaint Regarding Jet Fuel Line Abandonment of Service

ORDER
WHEREAS:
A. By letter dated April 30, 2021, PKM Canada (Jet Fuel) Inc. (PKMJF) informed the British Columbia Utilities Commission (BCUC) that the company’s approximately 41 kilometre long pipeline used to transport aviation turbine fuel (jet fuel) from the Westridge Marine Terminal in Burnaby to the Vancouver International Airport (the Jet Fuel Line, or JFL) had been shutdown effective immediately;
B. By letter dated May 14, 2021, PKMJF informed the BCUC of its intention to permanently discontinue service on the JFL;
C. By letter dated May 14, 2021, the Vancouver Airport Fuel Facilities Corporation (VAFFC) filed a complaint with the BCUC regarding the current abandonment of service on the JFL and PKMJF’s intention to permanently abandon service (Complaint);
D. By Order G-154-21, dated May 20, 2021, the BCUC issued Directive 2, as follows: “PKMJF is directed to return the JFL to service, with all necessary safety measures and regulatory approvals in place, as soon as possible, but by no later than 30 days from the issuance of this order unless PKMJF can provide evidence satisfactory to the BCUC that it is unable to do so.”;
E. The return to service deadline established in Directive 2 was varied and extended by several subsequent orders. The most recent return to service deadline of June 30, 2022, was established through Order G‑127‑22, dated May 13, 2022;
F. By Orders G-154-21, G-174-21, and G-261-21, dated May 20, 2021, June 3, 2021, and September 3, 2021, respectively, PKMJF was directed to submit weekly written updates and to host biweekly conference calls regarding the JFL return to service;
G. By letter dated June 28, 2022, PKMJF notified the BCUC that it was accepting infill on the JFL and service would be restored as of June 29, 2022;
H. By letters dated July 6, 2022 and July 15, 2022, Parkland Refining (B.C.) Ltd. and VAFFC, respectively, indicated that they have no objection to the BCUC closing the Complaint; and
I. The BCUC has reviewed the evidence and submissions in this proceeding and is satisfied that:
(i) the JFL has been returned to service and weekly written updates and biweekly conference calls regarding the JFL return to service are no longer required; and
(ii) the Complaint has been resolved.
NOW THEREFORE the BCUC orders that the Complaint is closed.
