Request for Approval of an Amending Agreement

Regarding Transportation Service on the Jet Fuel Line

ORDER

WHEREAS:

 

A.      By Order P-1-22, dated February 17, 2022, the British Columbia Utilities Commission (BCUC) approved final tolls for PKM Canada (Jet Fuel) Inc.’s (PKMJF) jet fuel pipeline and associated facilities (JFL). The approved tolls result from the toll methodologies set out in Attachment A of the negotiated settlement agreement filed in the PKMJF 2019 Tariff Filing Application and marked as exhibit B-94 in that proceeding (Agreement);

B.      By letter dated August 24, 2022, PKMJF requested BCUC approval of an amending agreement agreed to by PKMJF, the Vancouver Airport Fuel Facilities Corporation (VAFFC), and VAFFC’s member airlines (the Contracting Airlines) that would clarify the term “Applicable Shipper” as defined in the Agreement (Amending Agreement). Specifically, the existing definition of Applicable Shipper in the Agreement would be replaced with the following:

Applicable Shipper” means VAFFC, a Contracting Airline (or a Fuel Supply Agent designated by either of them) or a Non-Committed Shipper, as the context requires.; and

C.      The BCUC has considered PKMJF’s request and determines that approval of the Amending Agreement is warranted.

NOW THEREFORE the BCUC orders as follows:

 

1.       The Amending Agreement is approved.

2.       PKMJF is directed to provide copies of the Amending Amendment to the parties to the PKMJF 2019 Tariff Filing Application proceeding and to any shipper on the JFL.
