ORDER

WHEREAS:

 

A.      By letter L-17-22A dated May 24, 2022, the British Columbia Utilities Commission (BCUC) established a hearing process regarding its proposal to publish certain anonymized aggregate fuel data collected pursuant to the Fuel Price Transparency Act (FPT Act) (Proceeding);

B.      By Order G-147-22 dated June 1, 2022, the BCUC established a regulatory timetable for the Proceeding, including an opportunity for Responsible Persons to file written submissions and evidence regarding the BCUC’s proposal by July 22, 2022;

C.      By letter dated July 19, 2022, BCUC Staff stated that Responsible Persons had identified a need to resubmit certain historical fuel data through the FPT Act Reporting Portal and that such resubmissions could potentially impact the aggregate anonymized import-related fuel data proposed for publication. BCUC Staff requested an adjournment of the Proceeding to permit an evaluation by the BCUC of whether any modifications to the proposed aggregation methodologies would be appropriate;

D.      By Order G-204-22 dated July 21, 2022, the BCUC adjourned the proceeding pending resubmission of certain historical fuel data and to provide the BCUC an opportunity to evaluate whether any modifications to the proposed aggregation methodologies would be appropriate;

E.       Section 7(1) of the FPT Act requires a Responsible Person to make a supplementary submission within 30 days if the person becomes aware of a previous submission that was not accurate or complete; and

F.       The BCUC considers that an amendment to the regulatory timetable is warranted.

NOW THEREFORE the BCUC orders that the regulatory timetable attached as Appendix A to Order G-147-22 is amended as set out in Appendix A to this order.
