ORDER
WHEREAS:
A. On October 7, 2022, Aitken Creek Gas Storage ULC (ACGS) filed an Application to the British Columbia Utilities Commission (BCUC), requesting acceptance of housekeeping updates to its Code of Conduct (COC) and Transfer Pricing Policy (TPP), to update references and dates effective the first of the month following a BCUC order (Application);
B. By Order G-39-16, dated March 18, 2016, the BCUC approved the application by FortisBC Midstream Inc. (FMI) to acquire the shares of ACGS. ACGS continued to be regulated on a complaint basis, pursuant to Order G-71-08 that provided exemption from certain sections of the Utilities Commission Act;
C. Order G-39-16 directed ACGS to file a COC and TPP for BCUC approval by no later than the time FortisBC Energy Inc. (FEI) files its All-Inclusive COC and TPP;
D. On June 23, 2017, the BCUC issued Order G-100-17 to ACGS, approving the COC and TPP for ACGS, effective June 23, 2017; and
E. The BCUC reviewed the Application and determined that approval is warranted.
NOW THEREFORE pursuant to pursuant to sections 58 to 61 of the Utilities Commission Act, the BCUC orders as follows:
1. The ACGS’s updated COC and TPP are approved effective as of the date of this Order.
2. ACGS is directed to file within 15 days of the date of this Order, as a compliance filing, the updated COC and TPP.
