Apparent Contravention of the Utilities Commission Act

ORDER
WHEREAS:
A. By Order G-74-22 dated March 14, 2022, the British Columbia Utilities Commission (BCUC) approved Resort Gas’ Ltd. (Resort Gas) request to increase the total gas commodity charge for its Residential, Small Commercial and Large Commercial Rate Group. Directive 6 of that order directed Resort Gas to file the Propane Supply Agreement with the BCUC within 15 days of the contract execution date (Directive 6);
B. By Order G-130-06 dated October 27, 2006, the BCUC approved the Rules for Natural Gas Energy Supply Contracts (Rules). The Rules are intended to facilitate the BCUC’s review of natural gas energy supply contracts pursuant to section 71 of the Utilities Commission Act (UCA);
C. On May 30, 2022, Resort Gas filed the Propane Supply Agreement with the BCUC;
D. On June 21, 2022, BCUC staff notified Resort Gas that the Propane Supply Agreement filing was insufficient as required under section 71 of the UCA and sections 6, 7, 13 and 14 of the Rules and requested that Resort Gas file the required information as directed;
E. On June 22, July 12, August 15, August 18, August 24, 2022, BCUC staff followed up with Resort Gas and requested that it file the required information as directed. The BCUC did not receive the required information from Resort Gas;
F. By letter dated September 26, 2022, the BCUC requested that Resort Gas file the required information as a supplemental filing (Supplemental Filing) by October 10, 2022, and also stated that failure to file the requested information by the deadline may result in a potential non-compliance hearing;
G. To date, the BCUC has not received the Supplemental Filing and therefore does not have a sufficient filing of Resort Gas’ Propane Supply Agreement as required by Directive 6 of Order G-74-22; and
H. The BCUC seeks comments from Resort Gas on its apparent contravention of sections 42, 43 and 71 of the UCA and its non-compliance with Directive 6 in Order G-74-22.
NOW THEREFORE the BCUC directs Resort Gas to provide comments on the apparent contravention of the UCA and non-compliance with Order G-74-22 within 15 days of the date of this order.
