ORDER
WHEREAS:
A. On October 6, 2021, a complaint was filed with the British Columbia Utilities Commission (BCUC) concerning, amongst other things, whether Wyse Meter Solutions Inc. (Wyse) was operating as a public utility at multiple premises in British Columbia (BC) (Complaint);
B. On July 6, 2022, by Letter L-29-22, the BCUC suspended the Complaint and another four additional unresolved complaints against Wyse and determined that a public hearing to investigate Wyse’s status as a public utility is warranted;
C. On July 22, 2022, by Order G-203-22, the BCUC established a regulatory timetable which included public notice, intervener registration, letters of comment, BCUC and Intervener information requests (IR), with further process to be determined;
D. By Orders G-216-22 and G-249-22, the BCUC amended the regulatory timetable in response to Wyse’s request for additional time to provide public notice and to file responses to BCUC and Intervener IR No. 1;
E. On September 23, 2022, Wyse submitted its responses to BCUC and Intervener IR No. 1;
F. On October 13, 2022, Wyse submitted responses to letters of comment;
G. On October 21, 2022, by Order G-294-22, the BCUC amended the regulatory timetable for a further round of BCUC and Intervener IR, with further process to be determined;
H. On November 4, 2022, an additional letter of comment that was submitted on August 22, 2022, filed by
Mr. Kevin Malone, was placed onto the evidentiary record;
I. On November 6, 2022, the British Columbia Old Age Pensioners’ Organization et. al filed a request for an extension to file Intervener IR No. 2 which was granted by Order G-324-22;
J. On November 24, 2022, Wyse submitted its responses to BCUC and Intervener IR No. 2;
K. On December 14, 2022, Wyse submitted responses to letters of comment from persons who had not previously filed;
L. On December 20, 2022, by Order G-378-22, the BCUC amended the regulatory timetable for final argument;
M. On December 21, 2022, Wyse filed a request for an extension to file final argument; and
N. The BCUC determines that a further amendment of the regulatory timetable is warranted.
NOW THEREFORE the BCUC orders that the regulatory timetable amended by Order G-378-22 is amended as set out in Appendix A to this order.
