ORDER
WHEREAS:
A. On February 27, 2023, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval of the rates established in the fuelling services agreement between FEI and Smithrite Delivery Services Ltd. (Smithrite) (Smithrite-Kamloops Agreement) on a permanent basis, effective March 10, 2023 (Application);
B. FEI’s Compressed Natural Gas (CNG) fuelling station located at FEI’s operations centre in Kamloops, BC (Kamloops Fuelling Station) was constructed in 2017 to fuel FEI’s own CNG fleet vehicles. The BCUC subsequently approved fuelling rates for customers to receive CNG fuelling service from the Kamloops Fuelling Station;
C. On February 24, 2023, FEI and Smithrite entered into the Smithrite-Kamloops Agreement which establishes the terms, conditions and rates for Smithrite to receive CNG fuelling service from the Kamloops Fuelling Station, effective March 10, 2023. The rates established in the Smithrite-Kamloops Agreement are consistent with the rates which apply to all customers receiving service at the Kamloops Fuelling Station; and
D. The BCUC has reviewed the Application and finds that approval is warranted.
NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:
1. The rates established in the Smithrite-Kamloops Agreement are approved, on a permanent basis, effective March 10, 2023.
2. FEI is to file the Smithrite-Kamloops Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
