Permanent Rates and Agreement for the City of Burnaby for Fuelling Service from

the Burnaby Operations CNG Station

ORDER

WHEREAS:

 

A.      On June 6, 2023, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act, for approval of the rates established in the fuelling services agreement between FEI and the City of Burnaby (City of Burnaby-Burnaby Operations Agreement), on a permanent basis, effective June 21, 2023 (Application);

B.      By Orders G-72-17 and G-73-17 dated May 17, 2017, the BCUC determined that the compressed natural gas (CNG) fuelling station located on FEI’s property in Burnaby, British Columbia (Burnaby Operations Fuelling Station) met the requirements for a prescribed undertaking as defined by the Greenhouse Gas Reduction (Clean Energy) Regulation and approved the rate design and rates established in two separate fuelling services agreements, respectively, for CNG fuelling service from the Burnaby Operations Fuelling Station on a permanent basis, effective July 1, 2016;

C.      On June 2, 2023, FEI and the City of Burnaby entered into the City of Burnaby-Burnaby Operations Agreement which established the terms, conditions, and rates for the City of Burnaby to receive CNG fuelling service from the Burnaby Operations Fuelling Station, effective June 21, 2023. The rates established in the City of Burnaby-Burnaby Operations Agreement are consistent with the rates and rate design approved by Orders G-72-17 and G-73-17;

D.      On June 15, 2023, FEI responded to BCUC staff questions and filed an amending agreement dated June 14, 2023, to the City of Burnaby-Burnaby Operations Agreement (Amending Agreement No. 1). Amending Agreement No. 1 retains the rates established in the City of Burnaby-Burnaby Operations Agreement but removes the renewal terms and conditions; and

E.       The BCUC has reviewed the Application and responses to BCUC staff questions and determines that approval of the rates on a permanent basis is warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       The rates established for the City of Burnaby in the City of Burnaby-Burnaby Operations Agreement and Amending Agreement No. 1 are approved on a permanent basis, effective June 21, 2023.

2.       FEI is to file the City of Burnaby-Burnaby Operations Agreement and Amending Agreement No. 1 in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
