ORDER
WHEREAS:
A. On October 19, 2023, Creative Energy Mount Pleasant Limited Partnership (CEMP) requested that the filing date for filing the Mount Pleasant District Cooling System (DCS) Rate Design Application related to British Columbia Utilities Commission (BCUC) Order G-242-22, be amended from September 30, 2023 to October 31, 2023 (Application);
B. On August 22, 2022, the BCUC issued Order G-242-22 to CEMP, approving CEMP’s proposed rate design for its provision of cooling service to the development at Main Street and East Fifth Avenue in Vancouver, BC (Main Alley Development) (DCS). The directive on page 32 of the Decision accompanying Order G-242-22 directs CEMP to file its next Revenue Requirements Application (RRA) for the rate-setting period commencing January 1, 2024 by June 30, 2023;
C. On December 3, 2020, the BCUC issued Order C-5-20 to CEMP. The Certificate of Public Convenience and Necessity granted by Order C-5-20 is subject to specific terms, including the condition that CEMP may not amend the target dates for Buildings M3 or M5 or agree on any other dates with the Owner with regards to Phase 3 and section 3.9(h) of the Construction and Purchase Agreement without the prior approval of the BCUC;
D. On June 30, 2023, CEMP requested that the filing date for filing the DCS Rate Design Application related to BCUC Order G-242-22, be amended from June 30, 2023 to September 30, 2023;
E. On July 7, 2023, the BCUC issued Order G-177-23, varying the directive on page 32 of the Decision accompanying Order G-242-22 to reflect the amended filing date of September 30, 2023; and
F. The BCUC has reviewed the Application and considers that an amendment to the filing deadline of the DCS rate design application, is warranted.
NOW THEREFORE pursuant to section 99 of the Utilities Commission Act, the BCUC orders as follows:
1. The directive on page 32 of the Decision accompanying Order G-242-22 is varied as follows:
The Panel directs CEMP to file its next RRA for the rate-setting period commencing January 1, 2024 by October 31, 2023.
2. CEMP is directed to include an updated rates model reflecting any changes in expected costs or timing to complete the DCS with its next RRA for the rate-setting period commencing January 1, 2024.
