ORDER

WHEREAS:

 

A.      On September 27, 2023, pursuant to section 71 of the Utilities Commission Act, FortisBC Energy Inc. (FEI) filed with the British Columbia Utilities Commission (BCUC) an executed copy of the Mist Storage Agreement D (Agreement D Extension) negotiated between FEI and NW Natural for the period June 1, 2024, to
May 31, 2027 (Filing);

B.      By Order G-238-18 dated December 13, 2018, the BCUC accepted an Amendment to Mist Storage Agreement D.

C.      On June 8, 2023, the BCUC accepted FEI’s 2023/24 Annual Contracting Plan (2023/2024 ACP) by
Letter L-30-23;

D.      FEI requests that the Filing and associated documents be kept confidential in perpetuity due to their commercially sensitive nature; and

The BCUC has reviewed the Filing and is satisfied that the Agreement D Extension is consistent with the 2023/2024 ACP and is in the public interest.

 

NOW THEREFORE pursuant to section 71 of the Utilities Commission Act and the BCUC’s Rules for Natural Gas Energy Supply Contracts, the BCUC orders as follows:

 

1.       The Agreement D Extension between FEI and NW Natural is accepted as filed.

2.       The BCUC will keep the Filing, including the Agreement D Extension and associated documents, confidential until the BCUC determines otherwise as it contains commercially sensitive information.
