Permanent Rates and Agreement for Clark Reefer Lines Ltd. For CNG Fuelling Service 

from the Kamloops Station

ORDER

WHEREAS:

 

A.      On November 6, 2023, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act (UCA), for approval of the rates established in the fuelling services agreement between FEI and Clark Reefer Lines Ltd. (Clark) (Clark-Kamloops Agreement) on a permanent basis, effective November 10, 2023 (Application);

B.      FEI’s Compressed Natural Gas (CNG) fuelling station located at FEI’s operations centre in Kamloops, BC (Kamloops Fuelling Station) was constructed in 2017 to fuel FEI’s own CNG fleet vehicles. The BCUC subsequently approved fuelling rates for customers to receive CNG fuelling service from the Kamloops Fuelling Station;

C.      By Order G-264-23 dated October 6, 2023, the BCUC approved the rate design and rates sought in a fuelling services agreement, as amended by Amending Agreement No. 1, for Canadian Linen & Uniform Service to continue to receive CNG fuelling services from a fuelling station located in Burnaby, on a permanent basis, effective July 1, 2023 (Canadian Linen-Burnaby Operations Agreement). As part of the same order the BCUC directed FEI to apply to the BCUC for approval of any adjustments to the rates made pursuant to clause 4(c)(iv) of Part II of the Canadian Linen-Burnaby Operations Agreement. Clause 4(c)(iv) allows FEI, at its discretion, to temporarily reduce the dispensing rate from time to time under certain conditions;

D.      On November 6, 2023, FEI and Clark entered into the Clark-Kamloops Agreement which establishes the terms, conditions and rates for Clark to receive CNG fuelling service from the Kamloops Fuelling Station, effective November 10, 2023. The Clark-Kamloops Agreement also includes the same clause 4(c)(iv) of Part II as the Canadian Linen-Burnaby Operations Agreement. The rates established in the Clark-Kamloops Agreement are consistent with the rates which apply to all customers receiving service at the Kamloops Fuelling Station; and

E.       The BCUC has reviewed the Application and determines that approval is warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:

 

1.       The rates established for Clark in the Clark-Kamloops Agreement are approved, on a permanent basis, effective November 10, 2023.

2.       FEI must apply to the BCUC for approval of any adjustments to the rates made pursuant to clause 4(c)(iv) of Part II of the Clark-Kamloops Agreement.

3.       FEI is to file the Clark-Kamloops Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
