Permanent Rates and Agreement for Canada Minibins Ltd. for

Fuelling Service from the Annacis Island CNG Fuelling Station

ORDER

WHEREAS:

 

A.      On November 10, 2023, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act, for approval of the rates established in a fuelling service agreement between FEI and Canada Minibins Ltd. (Minibins) dated November 9, 2023 (Original Minibins-Annacis Island Agreement) for a fuelling service at the compressed natural gas (CNG) station located at Annacis Island in Delta, BC (Annacis Island Fuelling Station) on a permanent basis, effective November 30, 2023 (Application);

B.      By Order G-45-22 dated February 22, 2022, the BCUC determined that the Annacis Island Fuelling Station met the requirements of a prescribed undertaking as defined by the Greenhouse Gas Reduction (Clean Energy) Regulation. Order G-45-22 also approved FEI to use the rate design and rates established in six separate fuelling services agreements as amended by amending agreements (Anchor Customer Agreements), on an interim and refundable basis, effective January 18, 2022, for CNG fuelling service at the Annacis Island Fuelling Station. By Order G-198-23 dated July 25, 2023, the BCUC approved the rate design and rates established in the Anchor Customer Agreements as amended by amending agreements, on a permanent basis, effective January 18, 2022;

C.      On November 20, 2023, FEI and Minibins entered into an agreement amending the Original Minibins-Annacis Island Agreement (Amending Agreement No. 1) to revise the Rate Change Date from January 1 of each year to July 1 of each year. The Original Minibins-Annacis Island Agreement and Amending Agreement No. 1 are collectively referred to as the Minibins-Annacis Island Agreement;

D.      The Minibins-Annacis Island Agreement establishes the terms, conditions, and rates for Minibins to receive CNG fuelling service from the Annacis Island Fuelling Station, effective November 30, 2023. The rates established in the Minibins-Annacis Island Agreement are consistent with the rates approved by Order
G-198-23; and

E.       The BCUC has reviewed the Application and determines that approval of the rates established in the Minibins-Annacis Island Agreement on a permanent basis is warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       The rates established for Minibins in the Minibins-Annacis Island Agreement are approved on a permanent basis, effective November 30, 2023.

2.       FEI is to file the Minibins-Annacis Island Agreement in tariff supplement form for endorsement by the BCUC within 15 days of the date of this order.
