ORDER

WHEREAS:

 

A.      On December 2, 2022, Nelson Hydro filed an application for reconsideration and variance of Decision and Order G-196-22 pursuant to section 99 of the Utilities Commission Act with the British Columbia Utilities Commission (BCUC) in accordance with Part V of the BCUC’s Rules of Practice and Procedure (Reconsideration Application);

B.      By Orders G-392-22, G-34-23, G-73-23 and G-175-23, the BCUC established the regulatory timetable for the review of the Reconsideration Application, which included intervener registration, one round of BCUC and intervener information requests, and final and reply arguments;

C.      On November 15, 2023, by Order G-311-23, the BCUC issued its decision on the Reconsideration Application;

D.      Residential Consumer Intervener Association (RCIA) filed a Participant Cost Award (PCA) application with the BCUC with respect to its participation as an intervener in the proceeding, as follows:

E.       On December 12, 2023, Nelson Hydro advised that it has no comments on RCIA’s PCA Application; and

F.       The BCUC has reviewed the PCA application in accordance with the criteria and rates set out in the Rules of Practice and Procedure for Participant Cost Awards, attached to BCUC Order G-72-23. The BCUC concludes that the cost award should be adjusted to exclude costs for the decision review claimed by RCIA as it does not contribute to a better understanding of the issues in the proceeding and was incurred outside of the eligible period for claiming costs set out in Rule 32.03 of the BCUC’s Rules of Practice and Procedure.

 

NOW THEREFORE pursuant to section 118(1) of the Utilities Commission Act, the BCUC orders as follows:

 

1.       Funding is awarded to RCIA in the listed amount for its participation in the proceeding:

2.       Nelson Hydro is directed to reimburse RCIA for the awarded amount in a timely manner.
