ORDER

WHEREAS:

 

A.      On January 26, 2024, CB Powerline Ltd. (CBP) filed an application pursuant to sections 59 to 61 of the Utilities Commission Act (UCA) seeking British Columbia Utilities Commission (BCUC) approval of CBP’s proposed rates and terms of service (Application). CBP also requests direction for future proceedings, filings, and reports required by the BCUC;

B.      On December 17, 2021, the BCUC issued Decision and Order G-383-21 and ordered that a Certificate of Public Convenience and Necessity (CPCN) would be granted for the Cosens Bay community electrification project (Project) subject to CBP filing evidence to the satisfaction of the BCUC that the Okanagan Indian Band (OKIB) has been adequately consulted on the Project;

C.      On October 17, 2023, the BCUC issued Order C-4-23 determining that Crown consultation with OKIB has been adequate and granting CBP a CPCN for the Project; and

D.      The BCUC has commenced a review of the Application and determines that the following directives are warranted.

 

NOW THEREFORE pursuant to sections 59 to 61 of the UCA, the BCUC orders as follows:

 

1.       The regulatory timetable for the review of the Application is established as set out in Appendix A to this order.

2.       CBP is directed to provide a copy of the Application and this order to all shareholders of CBP, residents of the Cosens Bay community, and the Cosens Bay Property Owners Society by Friday, March 8, 2024.

3.       CBP is directed to provide written confirmation to the BCUC that it has complied with Directive 2 of this order by Tuesday, March 12, 2024.
