ORDER

WHEREAS:

 

A.      On February 29, 2024, Corix Burnaby Mountain DE Limited Partnership (Corix) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 and 89 of the Utilities Commission Act (UCA), for approval of its Burnaby Mountain District Energy Utility (BMDEU) revenue requirements and rates for 2024 and 2025 (Application);

B.      In the Application, among other things, Corix requests the following interim approval of rates for the BMDEU, effective March 1, 2024:

                  (i)            The Basic Charge as set out in the rate schedule filed in Section C of Appendix E to the Application for the UniverCity customer group; and

                (ii)            The Capacity, Consumption and Availability charges as set out in Section A of Appendix F to the Application for the Simon Fraser University (SFU) customer group;

C.      By Order G-236-23 and its accompanying decision for Stage 1 of the Generic Cost of Capital (GCOC) proceeding, the BCUC directed that interim rates be established, effective January 1, 2024, on a refundable or recoverable basis, for all utilities that use the Benchmark Utility to set their capital structure and equity return pending the BCUC’s final decision on Stage 2 of the GCOC proceeding; and

D.      The BCUC has commenced its review of the Application and determines that approving interim rates and establishing a regulatory timetable are warranted.


 

NOW THEREFORE pursuant to sections 59 to 61 and 89 of the UCA, the BCUC orders as follows:

 

1.       Corix is approved to charge the following rates on an interim, refundable or recoverable basis, effective March 1, 2024:

                  (i)            For UniverCity, the Basic Charge as set out in the rate schedule filed in Section C of Appendix E to the Application; and

                (ii)            For SFU, the Capacity, Consumption and Availability charges as set out in Section A of Appendix F to the Application.

2.       The treatment of any variance between the interim rates and the permanent rates, with interest calculated at Corix’s weighted average cost of capital, will be determined by the BCUC in a future order.

3.       The rate schedules presented in the tariff pages filed in Section C of Appendix E and Section A of Appendix F to the Application are accepted for filing.

4.       A regulatory timetable for the review of the Application is established as set out in Appendix A to this order.

5.       On or before Wednesday, March 27, 2024, Corix is directed to:

                  (i)            Provide notice of the Application and this order or post the Public Notice attached as Appendix B to this order, on Corix’s website and existing social media platforms. Social media reminder posts must be published on each platform on the last week of each month until the conclusion of the letters of comment period;

                (ii)            Provide a copy of this order and the Public Notice attached as Appendix B to this order, electronically where possible, to all customers of the BMDEU and registered interveners in the BMDEU 2020–2023 Revenue Requirements and Rates proceeding and the Application for Approvals relating to Restructuring and Business Combination Transactions proceeding; and

               (iii)            Post the Public Notice attached as Appendix B to this order on all major notice boards and in all major entry ways of the UniverCity customers’ buildings.

6.       Corix is directed to provide to the BCUC:

                  (i)            Confirmation of compliance with Directive 5’s public notice requirements due to be completed by Wednesday, March 27, 2024, in accordance with the regulatory timetable.

                (ii)            Confirmation of compliance with Directive 5’s public notice requirement of the social media reminder posts in accordance with the regulatory timetable.

7.       In accordance with the BCUC Rules of Practice and Procedure, parties who wish to actively participate in the proceeding must complete a Request to Intervene Form, available on the Get Involved in a Proceeding section of the BCUC's website at https://www.bcuc.com/GetInvolved/GetInvolvedProceeding, by Wednesday, May 1, 2024. Intervention requests will be limited to those persons or parties directly or sufficiently affected by the BCUC’s decision, particularly those who represent direct customers of the BMDEU.

CORIX 2024–2025 REVENUE REQUIREMENTS AND RATES APPLICATION FOR THE BURNABY MOUNTAIN DISTRICT ENERGY UTILITY

On February 29, 2024, Corix Burnaby Mountain DE Limited Partnership (Corix) applied to the British Columbia Utilities Commission (BCUC) for approval to increase rates for 2024 and 2025 for customers of the Burnaby Mountain District Energy Utility (UniverCity and Simon Fraser University), among other items.
