and Nelson Hydro Section 71 Energy Supply Contract with Small Power Producer

WHEREAS:
on March 21, 2024 ORDER
A. On February 1, 2024, pursuant to section 71 of the Utilities Commission Act (UCA) and section 1.1 of the Rules for Energy Supply Contracts for Electricity (Rules), Nelson Hydro filed with the British Columbia Utilities Commission (BCUC) an energy supply contract between Nelson Hydro and dated November 1, 2022 (Nelson Hydro ESC) (Filing);
B. By Order G-61-12 dated May 17, 2012, the BCUC approved the Rules. The Rules facilitate the BCUC’s review of energy supply contracts for electricity, and proposed energy supply contracts for electricity under section 71 of the UCA;
C. Nelson Hydro requests that the Nelson Hydro ESC be kept confidential to protect personal information. Nelson Hydro advised that it has provided notice of the Filing and a redacted version of the Nelson Hydro ESC to interveners in Nelson Hydro’s 2023 Revenue Requirements Application; and
D. The BCUC has reviewed the Filing and is satisfied that the Nelson Hydro ESC is in the public interest.
NOW THEREFORE the BCUC orders as follows: 1. The BCUC accepts the Nelson Hydro ESC as filed. 2. The Nelson Hydro ESC will be kept confidential until the BCUC determines otherwise.
