Re: Access Gas – Third-Party Verification Script for Natural Gas Agreements with Index Settlement
Dear Ms. Meixner:
On August 23, 2023, Access Gas Services Inc. (Access Gas) filed with the British Columbia Utilities Commission (BCUC) an application for a licence to market natural gas in British Columbia (Licence Application). Included in the Licence Application were templates for two new natural gas agreements with index settlements (Index Agreements) for BCUC approval. On October 30, 2023, the BCUC issued a gas marketer licence to Access Gas by BCUC Order A-8-23 and determined that the Index Agreements would be reviewed as a separate matter.
On February 28, 2024, the BCUC informed Access Gas, by Letter L-3-24, that while the BCUC may review customer gas supply agreements/contracts as part of the licensing process, it does not provide approvals for customer gas supply agreements/contracts. In the same letter, the BCUC requested a complete version of the Third-Party Verification (TPV) script for the Index Agreements.
On March 6, 2024, Access Gas filed with the BCUC a TPV script for the Index Agreements. On March 14, 2024, BCUC staff issued questions regarding the TPV script for the Index Agreements. On March 20, 2024, Access Gas filed its responses along with an updated version of the TPV script for the Index Agreements.
The BCUC has reviewed Access Gas's revised TPV script and accepts the enclosed version to be in compliance with the Code of Conduct for Gas Marketers. Access Gas is to use the approved script in all TPV calls regarding the Index Agreements or until such time that the BCUC approves a new version of the script.
