BEFORE:

on April 15, 2024
ORDER
WHEREAS:
A. On June 30, 2023, the British Columbia Utilities Commission (BCUC) received a complaint filed by S.U.C.C.E.S.S Affordable Housing Society (SUCCESS) and the City of Vancouver (City) (collectively, the Complainants), regarding the inability to reach an agreement with Cambie Gardens Energy Limited Partnership (CGE) on the rates and terms for the delivery of thermal energy services from the CGE Thermal Energy System (TES) (Complaint);
B. By Order G-271-23 dated October 12, 2023, and as amended by G-306-23 dated November 10, 2023, and G-5-24 dated January 11, 2024, the BCUC established a regulatory timetable to hear the Complaint. The timetable consisted of two rounds of information requests (IRs) and final and reply arguments;
C. On March 19, 2024, CGE and the Complainants filed their respective final arguments;
D. By letter dated April 2, 2024, the BCUC requested that CGE file specific information;
E. On April 5, 2024, CGE filed information in response to the BCUC’s April 2, 2024 request;
F. Also on April 5, 2024, the Complainants filed a letter requesting an opportunity to file IRs on the new information filed by CGE and requesting that the BCUC extend the deadline for reply arguments to allow time to review the new information. Alternatively, the Complainants request the opportunity to file supplemental argument once their review is complete;
G. By letter dated April 8, 2024, the BCUC notified the parties that the remaining regulatory timetable would be amended, and that the revised dates would be provided in due course; and
H. The BCUC determines that CGE has not adequately responded to the BCUC’s April 2, 2024 request and further information from CGE is required. The BCUC will consider the Complainants request to file IRs upon receipt and review of the required information.
NOW THEREFORE the BCUC orders that CGE is to file the additional information as set out in the letter included as Appendix A to this order by Monday, April 22, 2024.
DATED at the City of Vancouver, in the Province of British Columbia, this 15th day of April 2024.
