ORDER

WHEREAS:

 

A.      On March 14, 2024, British Columbia Hydro and Power Authority (BC Hydro) filed an application seeking  acceptance of its Demand Side Measures (DSM) Fiscal 2024 Expenditure Schedule (Application) pursuant to section 44.2 of the Utilities Commission Act (UCA);

B.      By Decision and Order G-91-23 dated April 21, 2023, in the BC Hydro Fiscal 2023 to Fiscal 2025 Revenue Requirements proceeding, in Directive 75 the British Columbia Utilities Commission (BCUC) directed
BC Hydro to submit a proposal in its next revenue requirement application to update its DSM funding transfer rules to include provisions to address a funding shortfall in the final year of a DSM plan for no more than 5 percent, and any other changes to the DSM funding transfer rules it deems necessary;

C.      In the Application, BC Hydro is requesting either:

1.       Acceptance of changes to its DSM transfer rules to provide flexibility for BC Hydro to manage the timing of expenditures on its DSM plans; or

2.       Acceptance of the additional fiscal 2024 expenditures DSM expenditures of $3.6 million for capacity-focused programs, pursuant to section 44.2 of the UCA;

D.      The public version of the Application provided by BC Hydro redacts certain information related to the Industrial Curtailment program; and

E.       The BCUC has commenced review of the Application and considers that establishing a regulatory timetable is warranted.

NOW THEREFORE the BCUC orders as follows:

 

1.       The regulatory timetable for the review of the Application is established as set out in Appendix A to this order.

2.       BC Hydro is directed to provide notice of the Application and this order by Friday, April 19, 2024, electronically to the registered interveners in the BC Hydro Fiscal 2023 to Fiscal 2025 Revenue Requirements proceeding.

3.       BC Hydro must provide written confirmation to the BCUC of compliance with the Directive 2 above by Thursday, April 25, 2024.

4.       BC Hydro is directed to provide the information required by Rule 18 of the BCUC’s Rules of Practice and Procedure in support of any requests for confidential treatment of information in the Application by Thursday, April 25, 2024.

5.       In accordance with the BCUC’s Rules of Practice and Procedure, parties who wish to actively participate in the proceeding must complete a Request to Intervene Form, available on the Get Involved in a Proceeding section of the BCUC's website at https://www.bcuc.com/GetInvolved/GetInvolvedProceeding by Thursday, April 25, 2024.

6.       Parties may submit letters of comment by completing a Letter of Comment Form by Thursday, May 23, 2024.
