between FAES and Superior Propane at Oliver’s Landing

ORDER
WHEREAS:
A. On March 26, 2024, pursuant to section 71 of the Utilities Commission Act (UCA), FortisBC Alternative Energy Services Inc. (FAES) filed with the British Columbia Utilities Commission (BCUC) for acceptance of a proposed propane supply agreement (Agreement) between FAES and Superior Plus LP (Superior Propane) for the period from April 1, 2022, to March 31, 2024 (Filing);
B. On April 5, 2024, FAES submitted an update to the Filing, which included an executed copy of the Agreement for acceptance by the BCUC;
C. By Order G-130-06 dated October 27, 2006, the BCUC approved the Rules for Natural Gas Energy Supply Contracts (Rules). The Rules are intended to facilitate the BCUC’s review of natural gas energy supply contracts pursuant to section 71 of the UCA;
D. By Letter L-43-23 dated August 8, 2023, the BCUC accepted the FAES Oliver’s Landing 2023-2024 Annual Contracting Plan;
E. FAES requests that the Filing be kept confidential in perpetuity due to its commercially sensitive nature; and
F. The BCUC reviewed the Filing and considers acceptance of the Agreement is warranted.
NOW THEREFORE pursuant to section 71 of the UCA and the Rules:
1. The BCUC accepts the Agreement between FAES and Superior Propane as filed with the BCUC on April 5, 2024.
2. The BCUC will keep the Filing confidential until the BCUC determines otherwise as it contains commercially sensitive information.
