ORDER

WHEREAS:

 

A.      On April 25, 2024, Powell River Energy Inc. (PREI) filed a Notice of Appeal with the British Columbia Utilities Commission (BCUC) respecting BCUC Orders G-332-23 and G-91-24 (Appeal), and a request for a stay of these orders pursuant to section 102 of the Utilities Commission Act (UCA) pending the outcome of the Appeal;

B.       By Order G-332-23 dated December 6, 2023, the BCUC determined that PREI is a public utility as defined in section 1 of the UCA;

C.       By Order G-91-24 dated March 27, 2024, the BCUC dismissed PREI’s request for reconsideration of
Order G‑332‑23;

D.      PREI submits that a stay of the relevant decisions and orders while the Appeal is considered by the British Columbia Court of Appeal will not affect any public interest or any other party; and

E.       The BCUC considers the following determination is warranted.

 

NOW THEREFORE the BCUC orders pursuant to section 102(2) of the UCA that the operation of Orders G-332-23 and G-91-24 is stayed pending the outcome of the Appeal.
