WHEREAS:

on July 5, 2024 ORDER

A. On March 4, 2024, FortisBC Energy Inc. (FEI) filed an application (Application) with the British Columbia Utilities Commission (BCUC) pursuant to section 71 of the Utilities Commission Act (UCA);

B. FEI requests that the Application be kept confidential in perpetuity due to its commercially sensitive nature and to ensure that FEI’s ability to obtain favourable commercial terms for future natural gas contracting is not impaired;

C. By Order G-68-24 dated March 14, 2024, the BCUC established the regulatory timetable for review of the Application, which included one round of information requests and further process to be determined;

D. By Order G-126-24 dated May 1, 2024, the BCUC established a further regulatory timetable with an opportunity for FEI to submit final argument;

E. On May 21, 2024, FEI submitted its final argument; and F. The BCUC has considered the Application, evidence, and argument filed in the proceeding, and makes the following determinations.

Order E-16-24 NOW THEREFORE pursuant to section 71 of the UCA, and for the reasons outlined in the decision accompanying this order, the BCUC orders as follows:

1. The BCUC declares the Agreement wholly unenforceable. 2. The redacted portions of this order, the entirety of the decision attached to this order and all related material filed in this proceeding shall be held confidential until the BCUC determines otherwise.
