Cancellation of Tariff Supplement K-4 Biomethane Long

Term Large Volume Interruptible Sales Service Agreement Between FEI and BC Transit

ORDER

WHEREAS:

 

A.      On July 2, 2024, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission (BCUC), pursuant to sections 59 to 61 of the Utilities Commission Act, for cancellation of Tariff Supplement K-4 to Rate Schedule (RS) 5B, a Biomethane Long Term Large Volume Interruptible Sales Service Agreement (Tariff Supplement K-4) between FEI and BC Transit (BC Transit Agreement), effective June 30, 2024 (Application);

B.      FEI and BC Transit executed the BC Transit Agreement in 2022, with an effective date of July 22, 2022;

C.      By Order G-271-22 dated September 29, 2022, the BCUC approved Tariff Supplement K-4, effective October 1, 2022, on a permanent basis;

D.      On March 20, 2024, the BCUC issued Order G-77-24 and accompanying decision, on FEI’s Biomethane Energy Recovery Charge Rate Methodology and Comprehensive Review of a Revised Renewable Gas Program. The BCUC approved, among other matters, setting the renewable natural gas (RNG) Charge for Natural Gas Vehicle Sales Customers at the forecast weighted average cost of RNG supply less the Storage & Transportation RNG Rider under the Voluntary RNG service;

E.       Pursuant to Section 1.6.6 of Tariff Supplement K-4, FEI provided notice to BC Transit on May 31, 2024 regarding Order G-77-24 and accompanying decision, and BC Transit advised on June 21, 2024 that it was terminating the BC Transit Agreement. Section 1.6.6 of Tariff Supplement K-4 provides that the BC Transit Agreement will be terminated immediately on the provision of such notice; and

F.       The BCUC has reviewed the Application and determines that the amendment to remove the BC Transit Agreement from Tariff Supplement K-4 is warranted.

 

NOW THEREFORE pursuant to section 61 of the Utilities Commission Act, the BCUC orders that the biomethane long term contracts specified in FEI’s tariff be amended to remove the BC Transit Agreement under RS 5B from Tariff Supplement K-4, effective June 30, 2024.
