Reconsideration of Order G-103-24

ORDER

WHEREAS:

 

A.      On March 7, 2024, Corix UBCDE Limited Partnership filed with the British Columbia Utilities Commission (BCUC) a Stream B Thermal Energy System (TES) System Extension Form to extend its Neighbourhood District Energy System at the University of British Columbia (UBC NDES) to connect and provide thermal energy service to two adjacent lots, Lot 5 - EPP86350 (BCR5) and Lot 6 - EPP86350 (BCR6) (Extension Application);

B.      By Order C-2-15, dated March 10, 2015, the BCUC granted a Certificate of Public Convenience and Necessity (CPCN) to Corix Multi-Utility Services Inc. for Phase 1 of the UBC NDES to serve certain new buildings in Wesbrook Place that were originally scheduled for completion between 2015 and 2023;

C.      By Order G-279-23, dated October 18, 2023, the BCUC granted certain approvals related to Corix
Multi-Utility Services Inc.’s restructuring and business combination transactions. The BCUC, among other things:

                                 i.            approved the transfer of the UBC NDES from Corix Multi-Utility Services Inc. to Corix UBCDE Limited Partnership;

                               ii.            granted a CPCN to Corix UBCDE Limited Partnership for the UBC NDES at the time of the pre-closing restructuring; and

                             iii.            rescinded the CPCN granted by Order C-2-15 at the time of the pre-closing restructuring;

D.      By Order G-103-24, dated April 5, 2024, the BCUC issued its decision on the Extension Application in which it amended the CPCN granted by Order C-2-15 to include connection of the UBC NDES to lots BCR5 and BCR6;

E.       On April 15, 2024, Corix Multi-Utility Services Inc. notified the BCUC that on April 1, 2024, Corix Multi-Utility Services Inc.’s pre-closing restructuring completed; and

F.       The BCUC, on its own motion, determines that rescinding Order G-103-24 is warranted as it amended a CPCN that had previously been rescinded by Order G-279-23. 

 

NOW THEREFORE pursuant to sections 46(7) and 99 of the Utilities Commission Act, the BCUC orders as follows:

 

1.       Order G-103-24 is rescinded.

2.       The CPCN granted to Corix UBCDE Limited Partnership for the UBC NDES by Order G-279-23 is amended to include connection of the UBC NDES to lots BCR5 and BCR6.
