ORDER

WHEREAS:

 

A.      On October 7, 2024, Plateau Pipe Line Ltd. (Plateau), a wholly-owned subsidiary of Pembina Pipeline Corporation and general partner of Pembina West Limited Partnership, filed an application (Application) with the British Columbia Utilities Commission (BCUC) for approval to abandon common carrier service on the northern segment (Northern Segment) of the western pipeline system (Western System) pursuant to sections 65 and 72(2) of the Utilities Commission Act;

B.      By Order G-262-24 dated October 18, 2024, the BCUC established a public hearing process and regulatory timetable to review the Application, including an opportunity for Intervener submissions and Plateau reply submissions;

C.      On November 1, 2024, Tidewater Midstream and Infrastructure Ltd. (Tidewater) filed its Intervener submission;

D.      On November 8, 2024, Plateau filed its reply to Tidewater’s submission, as well as a proposal for interim tolls for the Western System starting January 1, 2025;

E.       By Order G-301-24 dated November 19, 2024, the BCUC established a further regulatory timetable including submissions of:

(i) supplemental information from Plateau and Tidewater by November 27, 2024 (Supplemental Information); and

(ii) any further submissions by Plateau and Tidewater regarding interim tolls for the Western System and reply comments to the Supplemental Information by December 6, 2024;

F.       By letter dated December 9, 2024, Plateau requested the BCUC allow it to submit a reply to Tidewater’s December 6, 2024 submission;

G.      By letter dated December 11, 2024, Tidewater objected to Plateau’s request and submitted that, if Plateau is granted an opportunity to submit a reply, then Tidewater should also have the opportunity to reply to any new matters raised in Plateau's December 6, 2024 submission;

H.      The BCUC sees value in allowing parties an opportunity to reply to the December 6, 2024 submissions; and

I.         The BCUC considers establishment of a further regulatory timetable is warranted.

 

NOW THEREFORE the BCUC orders as follows:

 

1.       A further regulatory timetable, as set out in Appendix A to this order, is established.

2.       Any reply submissions filed by December 16, 2024 are to be limited solely to responding to the information contained in the parties’ respective December 6, 2024 submissions.
