ORDER
WHEREAS:
A. On July 23, 2024, the Western Electricity Coordinating Council (WECC), acting as the Administrator for the British Columbia Mandatory Reliability Standards Program (MRS Program), filed a recommendation to the British Columbia Utilities Commission (BCUC) to deregister Lehigh Cement (LHC) as a Distribution Provider (DP) and register LHC as a DP Underfrequency Load Shedding-Only (UFLS-Only), effective December 1, 2024 (Function Recommendation);
B. On December 19, 2024, WECC filed a recommendation to the BCUC to approve a name change for LHC to Heidelberg Materials Canada Limited, effective January 1, 2023 (Name Change Recommendation);
C. Section 125.2 of the Utilities Commission Act (UCA) assigns exclusive jurisdiction to the BCUC to determine whether a “reliability standard” as defined in the UCA, is in the public interest and should be adopted in British Columbia. On June 4, 2009, the BCUC issued Order G-67-09 specifying that entities subject to reliability standards (Entities) must register with the BCUC;
D. In accordance with the Administration Agreement between WECC and the BCUC, dated September 8, 2009 and renewed most recently on July 2, 2024, WECC makes registration recommendations in its role as the BCUC’s Administrator for the MRS Program;
E. Order R-40-17 approved the most recent version of the Rules of Procedure for Reliability Standards in British Columbia (ROP), which includes Appendix 1: Registration Manual (Registration Manual). The Registration Manual establishes that every owner, operator and user of an element of the Bulk Electric System (BES), as that term is defined in the North American Electric Reliability Corporation (NERC) Glossary of Terms and as adopted by the BCUC, is a candidate for registration with the MRS Program;
F. Pursuant to Section 2.3 of the Registration Manual, an Entity must notify WECC in writing of any change in circumstances that affects the Entity’s registration. Such revisions to registration could include, among other things, changes to the functions for which an Entity is registered, Entity deregistration, or Entity name change;
G. By Order R-36-12, the BCUC approved LHC’s registration to the MRS Program as a DP;
H. In 2024, LHC underwent a self-certification process, which initiated a review by WECC of LHC’s registration status as a DP as a result of changes to the Registration Manual following its initial registration. Based on the information provided by LHC, WECC concluded in the Function Recommendation that LHC’s assets qualify under the NERC BES definition approved by the BCUC and LHC qualifies to be deregistered as a DP and registered as a DP UFLS-Only effective December 1, 2024. WECC submits that its Function Recommendation is consistent with what it would determine in the U.S.;
I. On September 16, 2024, WECC received a request for a name change from LHC to Heidelberg Materials Canada Limited, which led to the issuance of the Name Change Recommendation; and
J. The BCUC has reviewed WECC’s Function Recommendation and Name Change Recommendation and makes the following determinations.
NOW THEREFORE pursuant to section 125.2(10) of the UCA and in accordance with the Registration Manual, the BCUC orders as follows:
1. LHC’s name change to Heidelberg Materials Canada Limited is accepted, effective January 1, 2023.
2. LHC is approved to be deregistered as a DP and registered as a DP UFLS-Only, effective December 1, 2024.
