Cancellation of Tariff Supplement J-52 Fuelling Services Agreement Between FEI and

Vimar Equipment Ltd. for CNG Fueling Services from the Burnaby Operations Facility in Burnaby, BC

ORDER

WHEREAS:

 

A.      On January 23, 2025, FortisBC Energy Inc. (FEI) applied to the British Columbia Utilities Commission. (BCUC), pursuant to section 61 of the Utilities Commission Act (UCA), for approval of the cancellation of Tariff Supplement J-52 containing the fueling services agreement between FEI and Vimar Equipment Ltd. (Vimar) to receive Compressed Natural Gas (CNG) fueling service from the FEI fueling station located at the Burnaby Operations Facility in Burnaby, BC (Burnaby Operations Fueling Station) (Vimar-Burnaby Operations Agreement), effective December 1, 2024 (Application);

B.      On February 5, 2025, in response to staff questions, FEI provided an update to the Application to correct the date of the Vimar-Burnaby Operations Agreement on the tariff supplement page;

C.      By Order G-321-19 dated December 9, 2019, the BCUC approved the rates established in the Vimar-Burnaby Operations Agreement, effective December 1, 2019, on a permanent basis;

D.      FEI advises in the Application that the Vimar-Burnaby Operations Agreement expired on November 30, 2024 and Vimar did not wish to renew;

E.       The Application also includes a proposed housekeeping change to the Index Page for FEI’s tariff supplements to correct a typographical error to the Renewal Term referenced for TS J-51; and

F.       The BCUC has reviewed the Application and determines that approval for the rescindment of Tariff Supplement J-52 and for the housekeeping change to the Index Page for TS J-51 is warranted.

 

NOW THEREFORE pursuant to section 61 of the UCA, the BCUC orders as follows:

 

1.       Tariff Supplement J-52 is rescinded, effective December 1, 2024.

2.       The housekeeping change to the Index Page in relation to TS J-51, set out in Appendix B of the Application, is approved.

3.       The tariff pages filed in Appendix B of the Application, as updated by FEI on February 5, 2025, are accepted as filed.
