On November 30, 2023, Wyse Meter Solutions Inc. (Wyse) filed an application (Application) with the British Columbia Utilities Commission (BCUC), seeking, among other things, a Certificate of Public Convenience and Necessity (CPCN) pursuant to sections 45 and 46 of the Utilities Commission Act (UCA) to install, own, and operate existing and future electricity and thermal energy submetering equipment and operating systems in multi-unit residential and commercial properties throughout British Columbia (BC);

By Orders G-1-24, G-92-24, G-113-24, G-140-24, and G-195-24 dated January 4, 2024, March 27, 2024, May 17, 2024, and July 19, 2024, respectively, the BCUC established and furthered a regulatory timetable for review of the Application, which included, among other things, public notice, intervener registration, BCUC and intervener information requests, and final and reply arguments;

On November 27, 2024, the BCUC issued Decision and Order G-312-24, wherein the BCUC found that granting Wyse an exemption from regulation under section 45 of the UCA for electricity submetering systems that Wyse acquires or constructs subsequent to November 27, 2024, serves the objects and purposes of the UCA and is in the public interest;

By letter dated January 17, 2025, Wyse informed the BCUC of the connection of a new electricity submetering system with service commencing in April 2024 that, due to an internal communications error, had not previously been reported to the BCUC. Wyse requested that this additional submetering system be granted a CPCN or captured within the scope of the recommended CPCN exemption;

By letter dated February 3, 2025, and as attached as Appendix A to this order, the Minister responsible for the administration of the Hydro and Power Authority Act granted advance approval to the BCUC to exempt Wyse from section 45 of the UCA with respect to electricity submetering systems that Wyse acquires or constructs after March 31, 2024; and

F. The BCUC considers that the following determinations are warranted. NOW THEREFORE the BCUC orders as follows: 1. Pursuant to section 88(3) of the UCA, the BCUC, having been granted advance approval by the Minister responsible for the administration of the Hydro and Power Authority Act, exempts Wyse from section 45 of the UCA for electricity submetering systems that Wyse acquires or constructs after March 31, 2024.

The exemption referred to in Directive 1 of this order remains in effect until the BCUC orders that the exemption no longer applies.

Dear Dr. Jaccard:

As requested by the British Columbia Utilities Commission (BCUC), I am providing my advance approval, as contemplated in s.88(3) of the Utilities Commission Act (UCA) for BCUC to issue an order to exempt Wyse Meter Solutions Inc. (Wyse) from section 45 of the UCA for electricity submetering systems that Wyse acquires or constructs after March 31, 2024. As set out in the draft exemption order attached to your January 22, 2025 letter, the BCUC may order that the exemption referenced in this advance approval no longer applies.

Based on the BCUC decision on this matter, I understand that Wyse will be required to file specified information about an electricity submetering system within 30 days after signing a submetering agreement with the building owner. This BCUC direction, along with other forms of continuing regulation, is intended to achieve an appropriate balance of regulation and protecting ratepayers.
