Operating Agreement between the City of West Kelowna and FortisBC Energy Inc.

ORDER

WHEREAS:

 

A.      On November 28, 2024, FortisBC Energy Inc. (FEI) filed an application (Application) to the British Columbia Utilities Commission (BCUC) for approval of an operating agreement dated November 27, 2024, between the City of West Kelowna and FEI (FEI-West Kelowna Operating Agreement), pursuant to section 23(1)(g) of the Utilities Commission Act (UCA);

B.      FEI requests that, if approved by the BCUC, the FEI-West Kelowna Operating Agreement should have an effective date on the first of the month following at least four weeks after approval to allow for implementation on customer bills;

C.      On December 11, 2024, the BCUC issued BCUC Staff Questions No. 1 to FEI;

D.      On December 23, 2024, FEI filed its responses to BCUC Staff Questions No. 1;

E.       By Order G-3-25, dated January 10, 2025, the BCUC established a public hearing process and a regulatory timetable for the review of the Application, which included public notice and letters of comment. The regulatory timetable established the deadline for letters of comment as February 6, 2025;

F.       By February 6, 2025, no letters of comment were received by the BCUC; and

G.      The BCUC has reviewed the Application and FEI’s responses to BCUC Staff Questions No. 1 and determines that approval is warranted.

NOW THEREFORE pursuant to section 23(1)(g) of the UCA, the BCUC orders that the FEI-West Kelowna Operating Agreement is approved on a permanent basis, effective April 1, 2025.
