FortisBC Energy Inc. and TransLink Amended and Restated Biomethane Long Term Large Volume Interruptible Sales Service Agreement under Rate Schedule 5RNG

ORDER

WHEREAS:

 

A.      On January 15, 2025, FortisBC Energy Inc. (FEI) filed with the British Columbia Utilities Commission (BCUC) for endorsement an Amending Agreement No. 1 to the FEI-South Coast British Columbia Transportation Authority (TransLink) Amended and Restated Biomethane Long Term Large Volume Interruptible Sales Service Agreement under Rate Schedule 5RNG filed as Tariff Supplement K-3 (Amending Agreement);

B.      By Order G-19-19 dated January 31, 2019, the BCUC approved the Rate Schedule 11B Tariff Supplement K-3 Biomethane Long Term Large Volume Interruptible Sales Agreement between FEI and TransLink on a permanent basis, effective February 1, 2019;

C.      By Order G-348-21 dated November 26, 2021, the BCUC approved the transfer of the Biomethane Long Term Large Volume Interruptible Sales Agreement between FEI and TransLink from Service under Rate Schedule 11B to Bundled Service under Rate Schedule 5B.

D.      By Order G-77-24 dated March 20, 2024, the BCUC directed a name change of Rate Schedule 5B to Rate Schedule 5RNG, which FEI has updated in Tariff Supplement K-3;

E.       Tariff Supplement K-3 allows for a five-year renewal term at the 5th anniversary of the commencement date. In the Amending Agreement, FEI and TransLink set out minimum and maximum purchase volumes for the renewal term;

F.       The BCUC has reviewed the Amending Agreement and considers that approval is warranted.

NOW THEREFORE pursuant to sections 59 to 61 of the Utilities Commission Act, the BCUC approves the Amending Agreement.
